Lawyer wants Sen. Frederick disciplined

KINGSTOWN, St. Vincent – A lawyer who represented Prime Minster Dr. Ralph Gonsalves in an election-related matter is considering asking Attorney General Judith Jones-Morgan to institute disciplinary proceedings against opposition lawmaker, Sen. Vynnette Frederick, a lawyer.

Frederick last week failed in the Court of Appeal to have the decision of a lower court overturned in relations to statements Gonsalves made during the campaign for the 2010 election, which she said affected her performance at the poll.

The legal proceedings related to Gonsalves’ saying that Frederick’s father “send a daughter to study law, and came back and get a son, … a tomboy”.

Frederick’s lawyers argued that Gonsalves was referring to their client’s sexual orientation and this affected the vote in West St. George, where she lost to Cecil “Ces” McKie of Gonsalves’ Unity Labour Party (ULP).

But Dominican Senior Counsel Anthony Astaphan pointed to inconsistencies in the contents of documents Frederick submitted to the court, including the word “lesbian”, which she said was inadvertently inserted in a transcript of a recording of Gonsalves comments.

“This insistency on her [part] on the 23rd of May that she heard the word ‘lesbian’ — after we wrote in December, after Stephen Williams sort with the affidavit exhibiting the transcript showing clearly that the word ‘lesbian’ was not used — is something that I find that we have to take very seriously,” Astaphan said on radio on Friday.

“Although we won the appeal and the matter is now at an end, we are seriously considering raising the matter with the Director of Public Prosecutions [Colin Williams] because we think it must have constituted a criminal offence and we are also thinking very seriously of taking up the matter with the Attorney General with a view to having disciplinary proceeding instituted against Vynnette Frederick for that sort of behaviour,” he said.

“We cannot allow lawyers who are politicians or politicians who are lawyers to deliberately mislead the court in material aspects in order to try to score a victory in the court for political gain. It is for me an unacceptable crossing of the line,” he said.

Frederick’s complaint, was among several filed by members of the opposition New Democratic Party, which won seven of the 15 parliamentary seats in 2010 while the incumbent ULP won eight, and was returned to office.

The complaints were filed under the Representation of the People Act, under which anyone convicted of an offence is barred from voting or being a member of the House of Assembly for five years.

If the ruling had gone against Gonsalves or any other government area representatives, they would have resulted in a fall of the ULP administration and fresh elections.

  2. Members of the NDP are such sore losers that they will try to use anything ( even dishonesty) to topple the ULP administration. This is dispicable. NDP , you LOST the last election. When will you guys accept this?.. Take it like a man and try to come better in 2015 please. These foolish attempts to overturn the democratically elected ULP administrstion are not working. It only make you guys look like a desperate, power-hungry bunch and it will result in you loosing some of the seats you have nnow. And Vynette , Shame on you. I cant stand lawyers who try to use the law to trick people. You have a daughter. Is this the kind of way you want to raise her?

    I remember this GIRL who used to climb mango trees better than most boys. She was a TOM BOY. Today, she is HAPPILY MARRIED and have 5 kids.

    I can give you more examples of girls I grew up with who were TOM BOYS and they’re all MARRIED or SINGLE with kids.

    Maybe in your time the TOM BOYS grew up to be something DIFFERENT. However, those in my time all grew up to be women with children.

    Astaphan specializes in the protection of communist scum throughout the Caribbean. He is disliked immensely in his own country and in many Caribbean islands.

    Astaphan is an ex-student of Gonsalves. He has earned huge fees over the last ten years from the Gonsalves regime, both for ULP government work and for Gonsalves personally generated litigation. No one knows if Gonsalves has paid any part of Astaphan’s fees or if its all paid from the government coffers.

    We are talking about many more times than a Vincentian can earn in a lifetime.

    As for disciplining Frederick, that would just prove how tuned into anti freedom of human rights this government is. Here we have an educated man like Gonsalves saying dreadful things about someone, and I doubt that he didn’t know it would damage her standing, in fact I believe it was done purposely just for that reason. And you want to punish the person who was damaged by Gonsalves.

    Then she is subjected to the law according to Astaphan, with the hope of gagging her forever.

    This is just another nasty example of Gonsalves spite.

    What you can be sure of, if someone had told a story of a Gonsalves gay encounter as a boy, he would of sued everyone and every media out of sight.

  15. Y’all does really crack me up on this blog. “AHA” the person making the claim couldn’t even present the evidence to substantiate. Even Frank Da silva went on radio and said that the Vinnie was trying to deceive the courts because he is the one who gave them the tapes so I aint see your point. You people are so blinded by hatred that ignorance fuels your everyday thoughts. The local courts trow out the case, the appeal court trow it out as well. If you all really believe they bias then take it to the privy council.

    Vynette SWORE an affidavit to the court. She told the court she was QUOTING Ralph DIRECTLY and she SWORE that Ralph used the word LESBIAN in the meeting. When u listen 2 d tape, Ralph didn’t say the word lesbian.
    Whether or not “tomboy” means “lesbian” is a different case. That aint the case Vynette bring to court.
    She bring a case to court saying Ralph call she a LESBIAN directly.
    Vynette had the tape. She listened to the tape. She transcribed the tape. And when she transcribed the tape, she ADDED IN the word “lesbian” – she put words in Ralph mouth
    It is a CRIME for a lawyer to enter false evidence into court. If your client go in the court and lie, well, that’s, life. But if a LAWYER, an OFFICER of the court, SWEARS to something she knwos is FALSE, that’s a crime.
    Look it up.
    So that’s why they talking about discipline her. Cuz she broke the rules of a lawyer and committed perjury.
    Just like she broke the rules when she tek out her camera in court and tek photos of Luke Browne in the dock and post them on Facebook. Just like she did when she take the camera out in parliament against the rules of the house.
    Vynette playing lawyer. She playing senator. But she don’t know the rules of either game.

  27. The thing here is we do not know for sure what went down in this issue. We do not know who was wrong or who was right because the matter never went to trail. The accused had a very good chance at a Civil suite but chose not to so can we really say for sure the accustion was correct?

  29. MOURINE, it is broadly believed by the people that the police woman was bought off by Gonsalves. All I know is that Gonsalves is a prolific litigator, if the woman lied on Gonsalves he would of sued her out of sight. He has been silent on the matter and has taken no action against her.

    Mourine we were told by the DPP there were 5 complaints against Gonsalves by different women, the DPP disallowed all.
